1.- PURPOSE
1.1. These Terms relate to:
- your access, navigation and use of the restricted user area (hereinafter, the “User Area”) on https://eu.poloclub.co.uk (the “Website”) following the creation of customer account with us; as well as
- customers who are members of our loyalty programme.
1.2. In signing up to be a registered user of our Website, you will be required to confirm your acceptance of these Terms, following which you will also become a member of our loyalty programme.
2.- ACCESS AND REGISTRATION
2.1. Access to the User Area is provided free of charge to UK residents who are aged 18 years or older.
2.2. To access the User Area, you must create an account by filling out the form available on the Website and following the instructions provided during the registration process.
2.3. It is your responsibility to make sure that any information you provide to us as part of the registration process is complete and accurate and we accept no responsibility for your failure to provide accurate information to us.
2.4. Once the registration process is completed, you will be required to select a password which meets our security criteria. It is your responsibility to keep your password secure and you must let us know if you are become aware of any anuathorised use of your account by emailing us at contact@poloclub.com.
2.5. In the event that you forget your password, you can let us know by clicking on the “forgot your password” link on our account login page. We will then send you instructions as to how to securely change your password.
3.- CANCELLATION
3.1. These Terms will apply as long as you hold a customer account with us. You may, at any time, send us a request to delete your account by sending an-email to us at: rgpd@poloclub.com, with the subject heading: CANCEL ACCOUNT.
3.2. If you would like to keep your customer account to make purchases, but no longer wish to be a part of the Loyalty Programme, please send an-email to us at: rgpd@poloclub.com,with the subject heading: UNSUBSCRIBE FROM LOYALTY PROGRAMME.
4.- TERMS OF USE OF THE USER AREA
4.1. In creating a customer account with us, you agree to make appropriate use of the User Area. You will be solely responsible for your use of the User Area and must, at all times: make proper use of the User Area, and only use it for the purposes for which it is provided.
4.2. Not share any information with us which is confidential or in breach of third party intellectual property rights.
4.3. Not use the User Area to spread or publish any material which is defamatory, offensive, racist, degrading, pornographic, obscene, threatening or that may cause discomfort to any other Registered User Area.
4.4. Not use the User Area to collect and process personal data of other Registered Users.
4.5. Not use the User Area in any way that could damage it or stop it working or do anything which might affect our systems or the systems of others (for example, by uploading viruses or malicious code or otherwise hack, bypass, or circumvent the security of our Website).
4.5. Not use the User Area for anything ilegal.
4.7. Not attempt to access the User Area with fake credentials or solicit login credentials from other Registered Users; not use our Wesbite in any way that breaches or inhibits other Registered User’s rights to use the Website.
4.8. Not copy, reproduce, crawl, frame, republish, download, print, post, distribute, broadcast, record, transmit, edit, link to, or distribute in any way the pages or materials found on our Website or User Area.
4.9. Your failure to comply with these Terms may result in us deleting or blocking your account and prohibiting you from using our User Area without us being responsible to you for any loss which you may suffer as a result. We also reserve the right to suspend or cancel your membership to the Loyalty Programme or to prevent you from using any loyalty points which you have earned in the event that you violate these Terms.
4.10. You will also be solely responsible to us and third parties for any losses which we or they may suffer as a result of your breach of these Terms.
5.- CONTENTS AND BENEFITS OF THE RESTRICTED AREA
5.1. When you open a customer account with us, you will be able to make purchases from the restricted area of our Website, access your purchase history and track the status of and access the history of your orders with us.
5.2. Upon creating your customer account, you will automatically be enrolled onto our Loyalty Programme. As a member of the Loyalty Programme, you will be entitled to:
- earn points on each purchase you make with us, which can be redeemed for discounts;
- gain early access to special promotions, offers, discounts and pre-orders; and
- participate in exclusive giveaways.
6.- SPECIFIC TERMS OF THE LOYALTY PROGRAMME
6.1. LOYALTY LEVELS OF THE POLO CLUB LOYALTY PROGRAMME
6.1.1. Registered Users which are part of our Loyalty Programme will be categorised by reference to the total value of purchases which they have made on our Website. In order to determine your loyalty status, we will take into account the amounts you have paid for our products (including taxes and shipping costs)
6.1.2. There are three loyalty levels:
- Loyal: loyal status is acquired at the time you make a customer account with us. However, you will not be entitled to enjoy the benefits associated with the Loyal level until you have made your first purchase on the Website. You will lose the benefit of any points or other benefits you have gained where you fail to make a purchases within a year of gaining such benefits.
- Loyal+: if you have a customer account with us and have made purchases with us in excess of £150 you will gain access to the Loyal+ level, exceded for the remainder of the calendar year in which such purchases were made. You must spend in excess of £150 in the following calendar year in order to remain a Loyal+ customer, otherwise you will go back to being a Loyal member.
- Beyond: if you have a a customer account with us and have made purchases with us in excess of £300 on our Website will gain access to the Beyond level, for the remainder of the calendar year in which you have made such purchases. You must spend in excess of £150 in the following calendar year in order to remain a Beyond customer, otherwise you will go back to being a Loyal member.

6.2. EARNING POINTS
6.2.1. The Loyalty Programme allows you to accrue points as you make purchases on the Website, provided that these purchases are made via your customer account. The points earned on each purchase will depend on your loyalty level, as follows:
- Loyal members: one point will be earned on each pound spent on the Website;
- Loyal+ members: one and a half points will be earned on each pound spent on the Website; and
- Beyond members: two points will be earned on each pound spent on the Website.
6.2.2. The Loyalty Programme will be applicable to all the products offered on the Website and the points will be calculated based on the total value of each order you place on the website (including the product price, VAT and shipping costs).
6.2.3. Any money spent on gift cards will also contribute to your points total, however purchases made with a gift card will not be considered for purposes of the Loyalty Programme
6.2.4. Any points earned by you as part of the Loyalty Programme are valid for 12 months from the date of purchase; after this period, your points will disappear.
6.3 OTHER WAYS TO EARN POINTS
6.3.1. You will also earn extra points in the following circumstances:
- when you create a customer account with us, you will be awarded 25 welcome points;
- If, as part of the sign up process, you share your data of birth with us, you will earn 100 points as a birthday gift from us. Please note that it may take up to 30 days for birthday points to display in your account; and
- when you follow POLO CLUB (https://www.instagram.com/poloclub) on Instagram, you will earn 10 points.
6.4. HOW TO ACCESS INFORMATION ABOUT YOUR POINTS
6.4.1. You will be able to check your points balance on our Website when you log in to your account. We will also inform you of your points balance via email from time to time.
6.4.2. We may contact you by post, email, SMS or other means of any information about the Loyalty Programme, including promotions, offers, private sales, and any commercial information of interest about the Loyalty Programme.
6.4.3. We may also use these channels to inform you of your loyalty level in the Loyalty Programme, and provide you with updates on your points balance, changes or any relevant information about the Loyalty Programme.
6.4.4. If you wish to contact us in relation to your online purchases, you should contact our Customer Service team by email at contact@poloclub.com. When doing so, please state the email associated to your account as well as your order number.
6.4.5. Any points earned by you as part of the Loyalty Programme are valid for 12 months from the date of purchase; after this period, these points will disappear.
6.5. USE OF THE LOYALTY DISCOUNT
6.5.1. You may redeem your loyalty points to obtain discounts on purchases through the User Area of the Website, as follows:
- where you have accrued 100 points, £5 will be deducted from a purchase of your choice, provided that you make the purchase using your customer account;
- where you have accrued 200 points, £10 will be deducted from a purchase of your choice, provided that you make the purchase using your customer account;
- where you have accrued 300 points, £15 will be deducted from a purchase of your choice, provided that you make the purchase using your customer account; and
- where you have accrued 400 points, £20 will be deducted from a purchase of your choice, provided that you make the purchase using your customer account.
6.5.2. You must use your points within 12 months of them being awarded to you. If points are not used within the stated time limit, they will expire and your points balance will refresh accordingly.
6.5.3. You will not be able to redeem any more than 400 points in relation to each purchase you make. Therefore, any points accrued in excess of 400 will remain in your points balance to be redeemed against future purchases you make.
6.5.4. If you request a refund in relation to an order which you placed with us against which you decided to redeem your loyalty points, you will not be entitled to receive replacement points as well as your refund.
6.5.5. You will be entitled to accrue loyalty points by reference to each purchase you make on our Website including where you use your loyalty points to make a purchase.
6.6. OTHER BENEFITS OF THE LOYALTY PROGRAMME
6.6.1. In addition to your ability to earn loyalty points, you will also receive other benefits as a member of our Loyalty Programme, depending on your loyalty level, as follows:
- Loyal members: gain access private sales;
- Loyal + members: gain access to exclusive private sales.

7.- INTELLECTUAL PROPERTY
7.1. The User Area, as well as its contents (texts, photographs, graphics, images, icons, technology, software, graphic design, source codes, among others) contain intelectual property rights which belong to us or third parties, who have consented to our use of their intellectual property rights.
7.2. Your ability to use the User Area does not constitute, in any case, a transfer of the intellectual property rights which are contained within it. Likewise, any trademarks, trade names or distinctive signs of any kind that appear in the User Area belong to us or, where appropriate, of third parties, who have consented to our use of their intellectual property rights.
7.3. You must not modify, copy, reproduce, publicly communicate, transform or distribute by any means and in any form all or part of the contents included in the User Area, for public or commercial purposes, without first obtaining the prior, express and written authorisation to do so from us.
8.- LIABILITY
8.1. We will take all the necessary measures to guarantee the correct functioning and continuous access to the User Area. However, we cannot guarantee continuous access in the event of programming or errors, or in the event that our Website is affected by viruses or other harmful components. POLO CLUB is not responsible for the information and content stored in, including but not limited to, forums, chats, blogs, comments, social networks or any other means that allows third parties to publish content independently in the User Area. We don't compensate you for all losses caused by us or our products. We are responsible for losses you suffer caused by us breaking our contract with you unless the loss is:
- Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
- Caused by a delaying event outside our control.
- Avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions for use.
- A business loss. It relates to your use of a product for the purposes of your trade, business, craft or profession.

10.- AMENDMENTS:
10.1. We reserve the right to make changes to our Website, and these Terms from time to time and will notify you of any material changes which you should be aware of.
11.- RESOLVING DISPUTES
11.1. You have several options for resolving disputes with us:

- You can go to court. These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
11.2. If a court invalidates some of these Terms, the rest will still apply. If a court or other authority decides that some of these Terms are unlawful, the rest will continue to apply.
11.3. Even if we delay in enforcing these Terms, we can still enforce them later. We might not immediately chase you for not doing something or for doing something you're not allowed to, but that doesn’t mean we can't do it later.
